Subject to the following terms and conditions, all of the images on this site are available to not-for-profit or partner organisations to download and use.
1. In consideration of you agreeing to these terms and conditions, we hereby grant you a royalty free non-exclusive revocable licence to reproduce the Images in non-commercial promotional or marketing materials.
The section below outlines your obligations:
2. You must:
2.1. reproduce our copyright notice on all reproductions of any of the Images, irrespective of medium
2.2. immediately inform us upon becoming aware of any unauthorised use of any of the Images or any other infringement (or suspected infringement) of our intellectual property rights by a third party;
2.3. not lend, redistribute or re-sell the Images nor exploit them for any direct financial gain;
2.4. not use or allow the Images to be used for any commercial purposes;
2.5. not use or reproduce the Images in any way, which is obscene, blasphemous, defamatory or in breach of any laws, statutory or regulatory requirements in the United Kingdom or such other jurisdiction in which you propose to use the Images.
2.6 not download in excess of 10 images per calendar month without our express consent
2.7 ensure that the maximum reproduction size does not exceed A5 or equivalent
2.8 forward a complimentary sample of published pictures (or notify the URL where images are used) no later than 30 days after publication. These should be sent to:

3. The copyright and other intellectual property rights in the Images are owned by the Northwest Development Agency or its licensors. Any rights not expressly granted in these terms are reserved. We do not grant you any right, title or interest in the Images. Any use by you of the Images other than in accordance with paragraphs 1 and 2 above for any purpose is strictly prohibited. If you breach any of these terms and conditions, your permission to use the Images shall automatically terminate and you must immediately destroy any Images in your possession or under your control.
4. You hereby acknowledge that we make the Images available to you “as is”, without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, we exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) which but for these terms and conditions might have effect in relation to the Images.
5. We exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in any way or in connection with your downloading of and use or inability to use the Images. Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury caused by negligence or fraud or any liability which cannot be excluded or limited under applicable law.
6. If you would like to use any of the Images for any purpose not authorised by these terms and conditions, you must seek our express written permission (which we may withhold at our absolute discretion). You should contact us via email at imagebank@nwda.co.uk if you would like to obtain such consent.
7. The photographers who provide our images may charge a fee for usage not authorised by these terms and conditions. This fee will be at the discretion of the photographer and will be agreed before the transaction/use takes place. The Northwest Regional Development Agency will have no involvement with this transaction and it will be agreed between the organisation or individual registered to use the ImageBank and the photographer
8. We may terminate the license granted under these terms and conditions at any time immediately upon notice to you. On termination of the license you must immediately cease use of the Images and destroy any versions of them.
9. No variation of these terms and conditions shall apply unless agreed in writing between our respective authorised representatives.
10. These terms and conditions and the license granted hereunder shall be subject to and construed according to English law and the parties hereby submit to the exclusive jurisdiction of the Courts of England.
